Il-politiki u l-liġijiet tal-UE adottati llum se jaffettwaw kemm liċ-ċittadini kif ukoll lin-negozji għall-ġenerazzjonijiet li ġejjin. L-aġenda għal Regolamentazzjoni Aħjar tiżgura tfassil tal-liġijiet tal-UE bbażat fuq l-evidenza u trasparenti msejsa fuq il-fehmiet ta’ dawk li jistgħu jiġu affettwati. Il-Kummissjoni kontinwament tevalwa u ttejjeb il-liġijiet tal-UE, billi tiffoka fuq il-kisba ta’ riżultati fejn huwa l-aktar importanti.

X'qed tagħmel il-Kummissjoni

Il-Kummissjoni Ewropea hi responsabbli għall-ippjanar, it-tħejjija u l-proposta ta' liġijiet u politiki ġodda tal-UE. Il-ħidma hi ggwidata mill-Programm ta' Ħidma annwali tal-Kummissjoni. Meta tipproponi l-liġijiet, il-Kummissjoni tivvaluta l-impatt mistenni tagħhom. Il-previżjoni strateġika hija element ewlieni fil-ħolqien ta’ politiki validi għall-futur fis-setturi kollha, b’enfasi partikolari fuq l-oqsma ekoloġiċi, diġitali, ġeopolitiċi u soċjoekonomiċi.

Il-Kummissjoni hija responsabbli wkoll għall-evalwazzjoni tal-liġijiet tal-UE u biex tipproponi titjib fejn meħtieġ. Il-Kummissjoni tkompli tissorvelja l-implimentazzjoni u l-applikazzjoni tagħhom fl-Istati Membri.

Biex jitrawwem l-irkupru tal-Ewropa, huwa ta’ importanza ewlenija li ssir leġiżlazzjoni b’mod traparenti u bl-aktar mod effiċjenti possibbli.

Il-Kummissjoni ilha tfittex evidenza u feedback mingħand iċ-ċittadini, in-negozji u l-partijiet ikkonċernati fl-istadji kollha tal-proċess leġiżlattiv u tat-tfassil tal-politika sa mill-2015. Tista’ taqsam il-fehmiet u l-ideat tiegħek dwar l-inizjattivi tal-Kummissjoni fl-oqsma kollha ta’ politika fuq il-portal Semma’ Leħnek. Huwa possibbli li wieħed jinkiteb għal notifiki dwar żviluppi ġodda hekk kif l-inizjattivi jieħdu forma, inkluż wara l-adozzjoni tal-leġiżlazzjoni.

Il-kontribuzzjoni tiegħek tagħmel differenza

Nissimplifikaw il-liġijiet tal-UE

Il-Kummissjoni qed tivvaluta l-prestazzjoni tal-liġijiet eżistenti tal-UE u qed twettaq tibdiliet fejn meħtieġ biex iżżommhom idoneji.

  • Il-Programm dwar l-Idoneità u l-Prestazzjoni tar-Regolamentazzjoni (REFIT) ġie stabbilit fl-2012 sabiex jagħmel il-liġi tal-UE aktar sempliċi u jnaqqas l-ispejjeż mhux neċessarji tar-regolamentazzjoni filwaqt li xorta waħda jintlaħqu l-benefiċċji.
  • Il-Pjattaforma Fit for Future – grupp ta' esperti ta' livell għoli magħmul mill-Istati Membri, il-Kumitat tar-Reġjuni, il-Kumitat Ekonomiku u Soċjali Ewropew u partijiet ikkonċernati li jirrappreżentaw lis-soċejtà ċivili, lin-negozji u lill-organizzazzjonijiet nongovernattivi. Il-grupp jassisti lill-Kummissjoni fit-titjib tal-liġijiet tal-UE billi jipprovdi opinjonijiet lill-Kummissjoni dwar il-potenzjal għas-simplifikazzjoni, it-tnaqqis tal-piżijiet u l-opportunitajiet ta’ modernizzazzjoni tal-liġijiet eżistenti tal-UE. Kulħadd jista’ jipproponi suġġerimenti għas-simplifikazzjoni tal-liġijiet eżistenti tal-UE permezz tal-portal Semma’ Leħnek: Issimplifika!.
  • L-evalwazzjonijiet u l-kontrolli tal-idoneità huma użati biex jivvalutaw jekk il-liġijiet, il-politiki u l-programmi ta' finanzjament tal-UE humiex iwasslu r-riżultati mistennija bi spiża minima.

Kull sena, il-Kummissjoni tippreżenta ħarsa ġenerali tal-isforzi tagħha dwar is-simplifikazzjoni u t-tnaqqis tal-piżijiet fl-Istħarriġ Annwali dwar il-Piżijiet. Hija timmonitorja wkoll b’mod regolari l-progress tal-programm fit-tabella ta’ valutazzjoni REFIT.

Niżguraw il-kwalità

Il-linji gwida u s-sett ta’ għodod għal Regolamentazzjoni Aħjar se jgħinu biex jipprovdu gwida konkreta lis-servizzi tal-Kummissjoni Ewropea meta jħejju inizjattivi u proposti ġodda kif ukoll fil-ġestjoni u fl-evalwazzjoni tal-leġiżlazzjoni eżistenti

Fl-2015, il-Kummissjoni stabbilixxiet il-Bord tal-Iskrutinju Regolatorju, korp indipendenti ta’ uffiċjali tal-Kummissjoni u esperti minn barra l-Kummissjoni. Il-Bord tal-Iskrutinju Regolatorju jirrevedi l-valutazzjonijiet tal-impatt u l-evalwazzjonijiet magħżula. Il-Bord jippubblika rapporti annwali, dwar x’għamel biex iwettaq il-missjoni tiegħu.

Insaħħu s-sussidjarjetà u l-proporzjonalità

Il-prinċipji tas-sussidjarjetà u tal-proporzjonalità huma l-pedamenti tat-trattati tal-UE, u huma applikati b’mod sistematiku għall-proposti leġiżlattivi tal-Kummissjoni.

Bil-prinċipju tas-sussidjarjetà, il-Kummissjoni għandha l-għan li taġixxi biss fejn meħtieġ u fejn twassal benefiċċji ċari li jmorru lil hinn mill-miżuri meħuda fil-livell nazzjonali, reġjonali jew lokali. Ħlief f’każijiet fejn l-UE għandha kompetenza esklużiva, m’għandhiex tittieħed azzjoni fil-livell Ewropew sakemm ma tkunx aktar effettiva minn azzjoni meħuda fil-livell nazzjonali, reġjonali jew lokali. Grilja tas-sussidjarjetà hija mehmuża mal-inizjattivi kollha politikament sensittivi u importanti flimkien ma’ valutazzjoni tal-impatt.

Il-proporzjonalità tiffoka fuq l-impatt finanzjarju u amministrattiv tal-leġiżlazzjoni proposta, biex tiżgura li l-azzjonijiet regolatorji ma jmorrux lil hinn minn dak li huwa meħtieġ biex jintlaħqu l-objettivi leġiżlattivi u politiċi. Kwalunkwe impatt bħal dan għandu jkun minimizzat u jkun proporzjonat mal-objettivi tal-politika. Għall-Kummissjoni dan ifisser li nwettqu l-politiki ambizzjużi tagħna bl-aktar mod sempliċi u bl-inqas spejjeż, filwaqt li nevitaw il-burokrazija żejda.

L-istituzzjonijiet tal-UE jaħdmu flimkien

It-titjib tat-tfassil tal-liġijiet tal-UE huwa objettiv komuni u r-responsabbiltà tal-istituzzjonijiet kollha tal-UE u tal-Istati Membri. L-aħjar mod biex jittejjeb it-tfassil tal-liġijiet tal-UE u jinkisbu riżultati aħjar huwa li l-Parlament Ewropew, il-Kunsill tal-Unjoni Ewropea u l-Kummissjoni Ewropea jaħdmu flimkien aktar mill-qrib fis-snin li ġejjin.

Minħabba l-opportunitajiet u l-isfidi li għandna quddiemna fit-triq tagħna lejn irkupru sostenibbli, huwa kruċjali li nilleġiżlaw bl-aktar mod effiċjenti possibbli, filwaqt li nżommu f’moħħna l-futur tagħna. L-applikazzjoni, l-implimentazzjoni u l-infurzar effettivi tal-liġi tal-UE huma prijorità għall-Kummissjoni von der Leyen. Il-Kummissjoni tista’ tiddetermina biss l-ispejjeż u l-iffrankar assoċjati mal-proposti leġiżlattivi tagħha stess. Il-bidliet li jsiru matul in-negozjati mal-Parlament Ewropew u mal-Kunsill jistgħu jbiddlu b’mod sinifikanti l-impatti fuq in-nies u n-negozji. Bħala tali, il-Kummissjoni tilqa’ t-tnedija mill-ġdid tad-djalogu politiku biex jiġu diskussi l-ideat, sabiex il-partijiet kollha jkunu jistgħu jissodisfaw l-impenji tagħhom skont il-ftehim interistituzzjonali dwar it-tfassil aħjar tal-liġijiet.

Il-Kummissjoni gradwalment se tagħmel il-bażijiet tad-data interni u r-repożitorji aċċessibbli għall-pubbliku, f’konformità mal-politika tagħna dwar it-trasparenza tad-data. Aħna se nikkomunikaw mal-Parlament Ewropew u lill-Kunsill biex nistabbilixxu reġistru komuni tal-evidenza, il-Portal Leġiżlattiv Konġunt, li se jippermetti lil kull min ikun interessat fit-tfassil tal-politika tal-UE jsib faċilment l-evidenza kollha li fuqha tkun ibbażata inizjattiva partikolari.

Kooperazzjoni regolatorja internazzjonali

L-UE hija mibnija fuq regoli maqbula b’mod komuni. Biex dawn ir-regoli jaħdmu, l-Istati Membri għandhom jimplimentawhom bis-sħiħ u jinfurzawhom f’waqthom. Imbagħad jeħtieġ li jiżguraw li r-regoli jiġu applikati u infurzati b’mod korrett, minħabba li n-nuqqas ta’ infurzar iġorr l-ispejjeż għaċ-ċittadini u n-negozji.

L-applikazzjoni, l-implimentazzjoni u l-infurzar effettivi tal-liġi tal-UE huma prijorità għall-Kummissjoni von der Leyen. Kif imħabbar fil-linji gwida politiċi tal-President von der Leyen, il-Kummissjoni se tkompli tiggwida u tappoġġja lill-Istati Membri fl-isforzi tagħhom biex jittrasponu d-direttivi, jimplimentaw ir-regolamenti u japplikaw ir-regoli tal-UE kif suppost. Il-kontrolli tal-konformità jivverifikaw kif l-Istati Membri jsarrfu l-leġiżlazzjoni tal-UE fil-leġiżlazzjoni nazzjonali. Biex jiġi żgurat djalogu effettiv fil-fażi tat-traspożizzjoni, aħna niddependu fuq l-Istati Membri għal informazzjoni ċara u preċiża dwar il-leġiżlazzjoni nazzjonali.

Għall-pass li jmiss, il-Kummissjoni beħsiebha twettaq rendikont tal-attivitajiet tagħha ta’ sorveljanza u infurzar, biex tiżgura li dawn jibqgħu adattati biex il-liġi tal-UE taħdem fil-prattika.

Improve public consultations by introducing a single ‘Call for Evidence’ translated in all languages, on the revamped Have Your Say portal. The approach combines the feedback on roadmaps and inception impact assessments with the questionnaire of public consultations into one.

Strengthening the Commission’s efforts to simplify EU rules and reduce unnecessary burdens, while achieving the benefits of legislation (REFIT programme) and by introducing the ‘one in, one out’ approach. This principle means that newly introduced burdens are offset by removing equivalent burdens in the same policy area. The Commission carried out an one-in, one-out pilot project in the second half of 2021, with ten legislative proposals covering a broad range of policy areas, impacting different sectors and stakeholders, to test the approach, its methodology and the related calculations. Building on the lessons learnt from the pilot, the Commission is now implementing ‘one in, one out’, starting with the 2022 Commission work programme. The Commission has also committed to rationalise reporting requirements with a view to reducing them by 25%.

The Commission has been seeking evidence and feedback from citizens, businesses, and stakeholders at all stages of the legislative and policymaking process since 2015.You can share your views and ideas on Commission initiatives across all policy areas on the Have Your Say portal. It is possible to sign up for notifications regarding new developments as initiatives take shape, including after the adoption of legislation.

You contribution makes a difference

Contributions from citizens, businesses and stakeholders make a real difference to EU policies. They have guided and improved the Commission’s work on several important initiatives, such as the European Citizens’ Initiative, the European Solidarity Corps, the Common Agricultural Policy and our Guidelines for the energy efficiency of buildings.

Simplifying EU laws

The Commission is assessing the performance of existing EU laws and making changes where necessary to keep them fit for purpose.

  • The Regulatory Fitness and Performance (REFIT) programme was established in 2012 to make EU law simpler and to reduce unnecessary costs of regulation while still achieving their objectives. Potential for simplification and burden reduction is always considered when legislation is evaluated and revised. All revisions of EU legislation are included under REFIT and aim to achieve burden reduction and simplification.
  • The Fit for Future Platform , replacing the REFIT platform, was set up in 2020. It is a high-level expert group composed of representatives of Member States, the Committee of the Regions, the European Economic and Social Committee and stakeholders representing civil society, business and non-governmental organisations. The Platform also works with the SME Envoys Network and the RegHub. The Platform issues opinions to the Commission with concrete suggestions on opportunities for simplification, burden reduction and modernisation of existing EU laws.
  • Anyone can propose suggestions for the simplification of existing EU laws through the Have Your Say: Simplify! portal.
  • Evaluations and fitness checks are used to assess whether EU laws, policies and funding programmes are delivering the expected results at minimum cost.

Every year, the Commission presents an overview of its efforts on simplification and burden reduction in the Annual Burden Survey. It also monitors regularly how simplification and burden reduction opportunities are considered throughout the policymaking cycle in the REFIT scoreboard.

Ensuring Quality

The Better Regulation guidelines and toolbox will help provide concrete guidance to European Commission services when preparing new initiatives and proposals as well as when managing and evaluating existing legislation.

In 2015, the Commission has established the Regulatory Scrutiny Board, an independent body of Commission officials and experts from outside the Commission.  The Regulatory Scrutiny Board reviews impact assessments and selected evaluations. The Board publishes annual reports on what it has done to deliver on its mission.

Strengthening subsidiarity and proportionality

The principles of subsidiarity and proportionality are cornerstones of the EU treaties, and are systematically applied to the Commission’s legislative proposals.

With the subsidiarity principle, the Commission aims to only act where it is necessary and where it delivers clear benefits over and above measures taken at national, regional or local levels. Except in cases where the EU has exclusive competence, action at European level should not be taken unless it is more effective than action taken at national, regional or local level. A subsidiarity grid is attached to all politically sensitive and important initiatives accompanied buy an impact assessment.

Proportionality focuses on the financial and administrative impact of proposed legislation, to ensure that regulatory actions do not exceed what is necessary to achieve the legislative and policy objectives. Any such impact must be minimised and must be proportionate to the policy objectives. For the Commission this means delivering our ambitious policies in the simplest, least costly way, avoiding unnecessary red tape.

The EU institutions working together

Improving EU law-making is a shared objective and the responsibility of all EU institutions and Member States. The best way to improve EU law-making and deliver better results is for the European Parliament, the Council of the European Union and the European Commission to work more closely together in the coming years.

Given the opportunities and challenges that lie ahead in our path to a sustainable recovery, it is crucial to legislate as efficiently as possible, with our future in mind. The effective application, implementation and enforcement of EU law is a priority for the von der Leyen Commission. The Commission can only determine the costs and savings associated with its own legislative proposals. Changes made during negotiations with the European Parliament and the Council may significantly alter impacts for people and business. As such, the Commission would welcome relaunched political dialogue to discuss ideas, so that that all parties can fulfil their commitments under the interinstitutional agreement on better law-making

The Commission will gradually make internal databases and repositories publicly accessible, in line with our data transparency policy. We will reach out to the European Parliament and the Council to set up a common evidence register, the Joint Legislative Portal, that will allow anyone interested in EU policymaking to find easily all the evidence underpinning a given initiative.

International regulatory cooperation

The EU is built on commonly agreed rules. For these rules to work, Member States must fully implement and enforce them in a timely fashion. They then need to ensure that the rules are correctly applied and enforced, because non-enforcement bears costs for citizens and businesses.

The effective application, implementation and enforcement of EU law is a priority for the von der Leyen Commission. As announced in President von der Leyen’s political guidelines, the Commission will continue to guide and support Member States in their efforts to transpose directives, implement regulations and apply EU rules properly. Compliance checks verify how Member States translate EU legislation into national legislation. To ensure effective dialogue in the transposition phase, we depend on the Member States for clear and precise information on national legislation.

Going forward, the Commission intends to carry out a stocktaking of its oversight and enforcement activities, to ensure that they remain fit for making EU law work in practice.
