Ozadje
Pravice posameznikov v EU so bile določene večkrat, na različne načine in v različnih oblikah.
Zato se je EU odločila, da jih vse vključi v enoten dokument, posodobljen v skladu z družbenimi spremembami, socialnim napredkom ter znanstvenim in tehnološkim razvojem.
Listina o temeljnih pravicah v enem dokumentu združuje vse osebne, državljanske, politične, ekonomske in socialne pravice ljudi v EU.
Te vključujejo:

vse pravice iz sodne prakse Sodišča Evropske unije,
-
pravice in svoboščine, zapisane v Evropski konvenciji o človekovih pravicah,
-
druge pravice in načela, ki izhajajo iz ustavnih tradicij, skupnih državam članicam EU, in drugih mednarodnih instrumentov.

Kaj zajema
Listina vsebuje pravice in svoboščine v okviru šestih naslovov:
- dostojanstvo,
- svoboščine,
- enakost,
- solidarnost,
- pravice državljanov,
- sodno varstvo.
Listina je za EU postala pravno zavezujoča decembra 2009 z začetkom veljavnosti Lizbonske pogodbe.
Da bi odražala sodobno družbo, vključuje temeljne pravice „tretje generacije“, kot so:
- varstvo podatkov,
- jamstva glede bioetike,
- pregledno upravljanje.
Pravice otroka
Spodbujanje in varstvo pravic otroka sta temeljna cilja EU, ki ju dodatno podpira tudi Lizbonska pogodba.
Listina z zapisom pravic otroka:

priznava, da je treba politike EU, ki neposredno ali posredno vplivajo na otroke, oblikovati, izvajati in spremljati ob upoštevanju načela otrokovih koristi,

zagotavlja pravico do varstva in skrbi, ki sta potrebna za dobrobit otrok,
-
priznava, da je treba otroke zaščititi pred zlorabami, zanemarjanjem in kršitvami njihovih pravic ter razmerami, ki ogrožajo njihovo dobrobit.
Evropska komisija hkrati z izvajanjem Listine spodbuja boj proti rasizmu, ksenofobiji in homofobiji ter zaščito pripadnikov manjšin.
Konvencija o človekovih pravicah
Listina je v skladu z Evropsko konvencijo o človekovih pravicah. Ko Listina vsebuje pravice, ki izhajajo iz te konvencije, sta njihov pomen in področje uporabe enaka.
Z Listino se krepi varstvo temeljnih pravic, saj so te pravice za državljane še bolj poudarjene in jasnejše.
Evropska komisija je leta 2010 sprejela strategijo za spremljanje in zagotavljanje učinkovitega uveljavljanja pravic in svoboščin iz Listine.
What it covers
The Charter contains rights and freedoms under six titles:
- dignity
- freedoms
- equality
- solidarity
- citizens' rights
- justice
The Charter has become legally binding on the EU with the entry into force of the Treaty of Lisbon, in December 2009.
To reflect modern society, the Charter includes 'third generation' fundamental rights, such as:
- data protection
- guarantees on bioethics
- transparent administration
Rights of the child
The promotion and protection of the rights of the child are two key objectives of the EU on which the Treaty of Lisbon has put further emphasis.
By enshrining the rights of the child, the Charter:
-
recognises that EU policies which directly or indirectly affect children must be designed, implemented and monitored taking into account the principle of the best interests of the child

guarantees the right to such protection and care as is necessary for the well-being of children
-
recognises the need to protect children from abuse, neglect and violations of their rights, and situations which endanger their well-being
In line with the implementation of the Charter, the European Commission is promoting the fight against racism and xenophobia, homophobia and the protection of persons belonging to minorities.
Convention on human rights
The Charter is consistent with the European convention on human rights. When the Charter contains rights that stem from this convention, their meaning and scope are the same
The Charter strengthens the protection of fundamental rights by making those rights more visible and more explicit for citizens.
In 2010, the European Commission adopted a strategy to monitor and ensure the effective implementation of the rights and freedoms in the Charter.
