Current statusOn 14 April 2026, a judgment of the Court of Justice of the European Union on a request for preliminary ruling from the Spanish Supreme Court [1], confirmed the Commission’s position in the open infringement procedure INFR(2014)4334 [2] against Spain regarding the transposition of Clause 5 of the Framework Agreement on fixed-term work annexed to Directive 1999/70/EC [3], and called into question the measures to penalise abuse arising from the use of successive fixed-term employment currently applicable in the Spanish public sector. In the framework of the mentioned infringement procedure, the Commission decided, on 29 April 2026, to issue a reasoned opinion to Spain.
