Introduction of mandatory judicial mediation

This reform aims to ensure parties' involvement in mandatory judicial mediation processes in defined civil and commercial cases by amending the relevant laws.

Bulgaria made legislative amendments to the Civil Procedure Code and the Law on Mediation introducing a legal obligation for the parties in certain civil and commercial disputes to take part in judicial mediation, as well as exceptions to mandatory mediation.

Furthermore, secondary legislation was adopted defining the organisation and operation of mediation centres and on the procedure of selection of mediators.

The reform ensures legal ground for the establishment of mediation centres in all 28 judicial districts and territorial divisions in every regional court.
