C 110/29

Planned closure of complaint 2005/4347

(2008/C 110/13)

The Commission services have completed their investigation of mass complaint case 2005/4347 regarding water management in the Lake Idro area with reference to an important site under Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora.

Following examination of the documentation submitted by the complainants and by the Italian authorities in the framework of the infringement procedure initiated by the Commission on 18 December 2005 (first letter of formal notice) and continued on 18 October 2006 (supplementary letter of formal notice), the Commission services have concluded that it is not possible, at this stage, to identify an infringement of Directive 92/43/EEC in the case in question. Consequently, the Commission services will propose to the Commission that the corresponding complaint case be closed.

Further details on the results of the examination may be found at the following website:

http://ec.europa.eu/community_law/complaints/multiple_complaints/

Should the complainants have new information about possible infringements of Community rules, this should be submitted to the Commission within a month of the publication of this notice.

This does not preclude the case being reopened and proceedings being re-initiated, should the Commission come into possession — even after closure — of new facts that could justify opening such a new procedure regarding the same issue.
